Welcome to Gigmora. By accessing or using our platform (www.gigmora.com), you agree to comply with and be bound by the following Terms and Conditions (“Terms”). Please read these Terms carefully before using the platform.
1. Definitions
- “Platform” refers to the Gigmora website and services.
- “User” refers to any person registered as a freelancer or client.
- “Freelancer” offers digital or e-commerce-related services.
- “Client” posts projects or hires freelancers for services.
- “Services” means the freelance work listed and delivered on the platform.
2. Eligibility
- At least 18 years of age.
- Legally able to enter into a binding contract.
- Not suspended or banned from any freelance platform for policy violations.
3. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate and up-to-date information.
- Gigmora reserves the right to suspend accounts for suspicious, abusive, or fraudulent activity.
4. Freelancer Services
- Freelancers may create gigs (services) with pricing, descriptions, and delivery terms.
- Gigmora may review and approve gigs before they go live.
- Freelancers must deliver services as described and on time.
- Failure to deliver may result in cancellation or account suspension.
5. Client Responsibilities
- Clients are responsible for funding their orders before starting a project.
- Clients may request revisions if offered in the gig scope.
- Clients may not use delivered work without full payment.
6. Payments & Fees
- Gigmora charges a [15 % commission] fee from freelancers on each transaction.
- Funds are released to freelancers after client approval or automatic release post-delivery.
- Withdrawal methods and thresholds may apply.
- All platform fees are non-refundable.
- Freelancers whose accounts are permanently suspended due to policy violations forfeit any remaining balance in their wallet. These funds will be held as a penalty and will not be paid out.
- All payments must be made and completed through the Gigmora platform only.
7. Dispute Resolution
- Disputes should first be resolved between freelancer and client.
- If unresolved, users may open a dispute through the platform.
- Gigmora will investigate and make a fair decision, which is final.
8. Prohibited Activities
- Engage in harassment, hate speech, or abusive behavior.
- Circumvent Gigmora to conduct payments or deals off-platform.
- Post false, misleading, or plagiarized content.
- Upload viruses or engage in unauthorized access.
- Attempt to move conversations or transactions outside Gigmora (e.g., by sharing phone numbers, emails, social handles, or external links for direct dealing).
- Share or request private contact information before placing an order.
- Redirect clients to another platform or personal channel for payment or communication.
- Attempt to avoid Gigmora’s service fees or commissions.
- Violation of these rules may result in immediate account suspension without prior warning.
- Gigmora is not responsible for any disputes, losses, or scams arising from communications or deals made outside the platform.
9. Intellectual Property
- All content created by freelancers is owned by the client upon full payment.
- Freelancers retain rights to work-in-progress until completion.
- Users agree not to copy, resell, or misuse any Gigmora content or code.
10. Limitation of Liability
- Gigmora is not liable for any loss of business, revenue, or damages caused by freelancer-client interactions.
- We do not guarantee outcomes or success from services purchased.
- The platform is provided “as is” without warranties of any kind.
11. Termination
- Gigmora reserves the right to permanently terminate any user account found to be violating platform rules, including attempts to redirect clients or handle payments off-platform.
- No balance will be paid to users whose accounts are terminated due to violation of core policies.
- Suspended users may not create a new account without written approval.
12. Amendments
- We may update these Terms at any time. We will notify users via email or platform alerts.
- Continued use of Gigmora means you accept the revised terms.
13. Governing Law
- These Terms shall be governed by and interpreted in accordance with the laws of [Insert Country/Region – e.g., UAE or your operational base].
